Abstract:

This research paper provides a comprehensive comparative study of Al-Fadala (Intervention in the affairs of others) within the Syrian Civil Law and Islamic Jurisprudence. It explores the legal nature of Al-Fadala as an application of "Unjust Enrichment" and its historical roots in French Law and Roman Law. The study details the essential pillars of intervention, the scope of the intervener's actions, and the legal obligations arising for both the intervener and the owner. Key legal articles (189-198 of the Syrian Civil Code) are analyzed, alongside the concepts of Faduli in Islamic schools of thought.
