Abstract:

This research provides a profound academic analysis of Al-Maslaha Al-Mursala (Unrestricted Public Interest), one of the most significant principles in Islamic Jurisprudence, particularly within the Maliki School. The paper discusses the linguistic and technical definitions of Maslaha, its classification into Essential ( الضرورية), Neccessary (الحاجية), and Complementary (التحسينية), and the varying stances of scholars regarding its validity as an independent legal source. It further examines the strict conditions required for its application to ensure it aligns with the higher objectives (Maqasid) of Sharia without contradicting definitive texts.
