"This research provides a rigorous legal examination of the evolution of Real Estate Ownership Proof in Algeria, highlighting the pivotal legislative shift in 1971. The study is divided into two primary eras: the pre-1971 period, characterized by customary contracts (Acts sous seing privé) and formal deeds, and the post-1971 era, which introduced the Land Registry System (Cadastre).
The paper analyzes the evidentiary weight of Land Titles (Livret Foncier) and temporary registration certificates in surveyed areas, while also addressing proof mechanisms in un-surveyed regions through notarial deeds, administrative contracts, and judicial rulings. This comprehensive guide is essential for understanding the transition from traditional possession-based proof to modern registration-based ownership, ensuring legal security in property transactions."
