Abstract:

This legal research provides an in-depth analysis of Adhesion Contracts (Contracts of Submission), which have emerged alongside modern economic developments and monopolies. The paper explores the legal nature of these contracts, presenting the debate between public and civil law scholars. It details the unique characteristics of adhesion, such as the inequality of bargaining power and the necessity of the services provided (electricity, water, insurance). Furthermore, it examines the Syrian Civil Law approach (Articles 150-152) and comparative Arab legislations in protecting the "adhering party" from arbitrary conditions. Finally, it contrasts these legal views with Islamic Jurisprudence, offering a comprehensive set of results and recommendations for achieving contractual justice.
