Director - Futures Commission Merchant (FCM)
We are in search of a knowledgeable and strategic Director to lead our compliance function for a registered Futures Commission Merchant (FCM). In an evolving landscape where prediction markets and event contracts play a central role as a modern asset class, this position entails developing, implementing, and managing a regulatory compliance program aligned with the guidelines of the Commodity Futures Trading Commission (CFTC) and the National Futures Association (NFA).
The FCM Director will act as the main interface with regulatory bodies, ensuring compliance with statutory duties outlined in 17 CFR § 3.3, overseeing market surveillance for event contracts, and collaborating closely with Product, Engineering, and Operations teams to establish scalable, automated controls in a dynamic fintech setting. This position will report to the Chief Compliance Officer for Crypto Derivatives North America and the Board of Directors.
Responsibilities:
Regulatory Governance & Mandatory Reporting
- Develop, implement, and maintain a compliance program that meets all obligations under the Commodity Exchange Act (CEA), CFTC regulations, and NFA rules.
- Prepare and submit the required Annual Report to the CFTC and the Board of Directors as per 17 CFR § 3.3.
- Act as the primary contact for the CFTC and NFA during examinations, audits, inquiries, and regulatory submissions.
- Provide guidance to executive leadership and the Board of Directors on regulatory changes, developments, and compliance risks tied to event contracts and prediction markets.
Prediction Market & Trade Surveillance
- Establish and supervise a comprehensive market surveillance program to identify, investigate, and prevent market manipulation and fraudulent trading practices in event contract markets.
- Create protocols to handle unique regulatory issues specific to prediction markets, such as contract outcome verification, event determination governance, and monitoring trading activities to prevent insider trading or conflicts of interest.
- Monitor order flows, account activities, and position limits in real-time across customer accounts.
Financial Crimes, AML & Customer Onboarding
- Oversee the FCM’s Anti-Money Laundering (AML), Know Your Customer (KYC), and Customer Identification Program (CIP) compliant with the Bank Secrecy Act (BSA) and NFA Rule 2-9.
- Direct the monitoring of transactions, rescreening for sanctions (OFAC), developing risk rating methods, and reporting suspicious activities (SARs).
- Maintain frameworks for customer protection, including rules governing the segregation of customer funds (CFTC § 1.20) and monitoring capital adequacy.
Operations, Product & Technical Integration
- Collaborate with Product, Engineering, and Operations teams to integrate automated compliance and surveillance controls into platform workflows.
- Review and approve marketing materials, promotional content, website information, and disclosures in accordance with NFA Rule 2-29.
- Supervise complaint handling, customer communications, record-keeping, and oversight controls under NFA Rule 2-9.
Required Experience:
- Minimum of 5 years in senior compliance roles within a CFTC-regulated entity (FCM, DCM, DCO, or Swap Dealer) or a financial regulatory agency.
- In-depth knowledge of the Commodity Exchange Act, CFTC regulations, NFA rules, and derivatives market structures.
- Practical experience in formulating and operating compliance monitoring, AML/KYC workflows, and market surveillance programs.
- Preferred: Previous registration or qualification to act as an FCM Chief Compliance Officer under 17 CFR § 3.3.
- Bachelor’s Degree in Finance, Business, Law, or a related field (J.D. or Master’s degree is a plus).
Salary Range: $150,000 - $250,000 per year
